Employment Practices Liability

Employment practices liability (EPL) coverage provides protection for an employer against claims made by employees, former employees, or potential employees. It covers discrimination (age, sex, race, disability, etc.), wrongful termination of employment, sexual harassment, and other employment-related allegations. It can also provide third party coverage (coverage to protect you if a non-employee is harassed at your office or while your employees are visiting other offices).

The latest trend is to provide coverage for wage and hour claims.  This is usually sub-limited but it is the fastest growing type of EPL claim and climbing.  Unlike D&O coverage which only protects the directors and officers from these claims, EPL actually protects the company and other non officers from these claims.

Minimum limits are usually $1,000,000 and the premiums vary depending on the revenues, numbers of employees, and locations of the employees.  An application is required and financials are almost always required.
